🇩🇪 Allgemeine Geschäftsbedingungen – Geführte E-Bike-Touren (RadyBike)

1. Geltungsbereich

Diese Bedingungen gelten für alle Buchungen und die Teilnahme an geführten E-Bike-Touren von RadyBike. Mit der Buchung erkennt der Teilnehmer diese Bedingungen an.

2. Vertragsabschluss

Der Vertrag kommt durch Buchung über das Online-Buchungssystem oder durch direkte Anmeldung beim Veranstalter zustande. Die Teilnahme ist erst nach vollständiger Bezahlung verbindlich.

3. Bezahlung

Die Bezahlung erfolgt in der Regel über die Online-Buchung. Alternativ kann die Bezahlung spätestens beim Treffpunkt vor Beginn der Tour in bar erfolgen. Ohne vollständige Zahlung besteht kein Anspruch auf Teilnahme.

4. Teilnahme und Fahrräder

Die Teilnahme ist mit einem eigenen E-Bike oder mit einem vom Veranstalter gemieteten E-Bike möglich.

Bei Mieträdern gelten zusätzlich die Mietbedingungen von RadyBike.

Es sind ausschließlich E-Bikes für die Touren zugelassen.

Eigene E-Bikes müssen sich in einem technisch einwandfreien und verkehrssicheren Zustand befinden. Die Bereifung muss für unterschiedliche Untergründe wie Asphalt, Schotter oder Waldwege geeignet sein.

Der Veranstalter kann Fahrräder vor Tourbeginn auf offensichtliche Sicherheitsmängel prüfen und Teilnehmer bei ungeeignetem Fahrrad von der Tour ausschließen.

5. Teilnahmevoraussetzungen

Die Teilnahme erfolgt auf eigene Verantwortung. Teilnehmer müssen sicher Fahrrad fahren können und gesundheitlich in der Lage sein, an der Tour teilzunehmen.

Minderjährige dürfen nur in Begleitung eines Erziehungsberechtigten teilnehmen.

Das Tragen eines Fahrradhelms wird empfohlen.

Die Straßenverkehrsordnung ist einzuhalten.

6. Tourablauf und Änderungen

Strecken, Zeiten und Programmpunkte dienen lediglich der Orientierung. Der Veranstalter kann Routen, Dauer, Pausen oder Ablauf der Tour aus organisatorischen, wetterbedingten oder sicherheitsrelevanten Gründen ändern.

7. Mindestteilnehmerzahl

Für die Durchführung einer Tour gilt eine Mindestteilnehmerzahl von 6 Personen. Wird diese nicht erreicht, kann die Tour abgesagt oder verschoben werden. Bereits gezahlte Beträge werden vollständig zurückerstattet.

8. Anweisungen des Guides

Den Anweisungen des Tourguides ist während der gesamten Tour Folge zu leisten. Teilnehmer können von der Tour ausgeschlossen werden, wenn sie Sicherheitsanweisungen missachten, andere Teilnehmer gefährden oder nicht fahrtauglich sind (z. B. Alkohol oder Drogen). In diesem Fall besteht kein Anspruch auf Rückerstattung.

9. Verspätung

Teilnehmer müssen pünktlich zum Treffpunkt erscheinen. Bei Verspätung ist der Veranstalter nicht verpflichtet zu warten. Bei verspätetem Erscheinen oder Nichterscheinen erfolgt keine Rückerstattung.

10. Stornierung

Stornierungen sind mit dem Veranstalter abzusprechen. Bei Nichterscheinen zur gebuchten Tour besteht kein Anspruch auf Rückerstattung.

11. Absage durch den Veranstalter

Der Veranstalter kann Touren aus wichtigen Gründen absagen, z. B. bei Krankheit des Guides, extremen Wetterbedingungen, Sicherheitsgründen oder zu geringer Teilnehmerzahl. In diesem Fall werden 100 % der Teilnahmegebühren zurückerstattet.

12. Haftung

Die Teilnahme erfolgt auf eigene Gefahr. Der Veranstalter übernimmt keine Haftung für Unfälle oder Schäden während der Tour, soweit kein vorsätzliches oder grob fahrlässiges Verhalten vorliegt. Teilnehmer müssen über ausreichenden Versicherungsschutz verfügen. Für persönliche Gegenstände wird keine Haftung übernommen.

13. Fotos und Videos

Während der Tour können Fotos oder Videos erstellt werden. Diese können zu Marketingzwecken (z. B. Website, Social Media oder Presse) verwendet werden.

14. Schlussbestimmungen

Sollte eine Bestimmung dieser Bedingungen unwirksam sein, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt. Es gilt italienisches Recht, da die Touren in Italien stattfinden und der Veranstalter ein italienisches Unternehmen ist.

🇬🇧 General Terms and Conditions – Guided E-Bike Tours (RadyBike)

1. Scope

These terms apply to all bookings and participation in guided e-bike tours organized by RadyBike. By booking a tour, participants accept these terms.

2. Contract

The contract is concluded through the online booking system or direct registration with the organizer. Participation becomes binding once full payment has been made.

3. Payment

Payment is usually made online. Alternatively, payment can be made in cash at the meeting point before the tour begins. Participation is only possible after full payment.

4. Participation and bicycles

Participants may join using their own e-bike or an e-bike rented from the organizer. If a rental bike is used, the rental terms of RadyBike apply.

Only e-bikes are permitted.

Personal e-bikes must be technically safe and suitable for road use. Tires must be suitable for mixed terrain such as asphalt, gravel or forest roads.

The organizer may check bicycles before the tour and may exclude participants with unsuitable bicycles.

5. Participation requirements

Participation is at the participant’s own responsibility. Participants must be able to ride a bicycle safely and be physically fit for the tour.

Minors may only participate if accompanied by a legal guardian.

Helmet use is recommended. Participants must follow local traffic regulations.

6. Tour changes

Routes, schedules and programs are indicative only. The organizer may change routes, duration or the schedule due to weather, safety or organizational reasons.

7. Minimum number of participants

A minimum of 6 participants is required for a tour to take place. If the minimum is not reached, the tour may be cancelled or rescheduled. Payments will be fully refunded.

8. Guide instructions

Participants must follow the instructions of the guide at all times. Participants may be excluded if they ignore safety instructions, endanger others or are not fit to ride (e.g. alcohol or drugs). No refund will be given in such cases.

9. Delay

Participants must arrive on time at the meeting point. The tour will not wait for late participants. No refund will be granted.

10. Cancellation

Cancellations must be agreed with the organizer. No refund will be issued for no-shows.

11. Cancellation by the organizer

The organizer may cancel a tour due to weather conditions, illness, safety reasons or insufficient participants. In this case, 100% of payments will be refunded.

12. Liability

Participation is at the participant’s own risk. The organizer is not liable for accidents or damages unless caused by intentional or gross negligence. Participants must have adequate insurance coverage.

13. Photos and videos

Photos or videos may be taken during the tour and may be used for marketing purposes (website, social media, press).

14. Final provisions

If any provision is invalid, the remaining provisions remain unaffected. Italian law applies as the tours take place in Italy and the organizer is an Italian company.

🇮🇹 Condizioni Generali – Tour guidate in E-Bike (RadyBike)

1. Ambito

Le presenti condizioni si applicano a tutte le prenotazioni e alla partecipazione alle tour guidate in e-bike organizzate da RadyBike. Con la prenotazione il partecipante accetta queste condizioni.

2. Contratto

Il contratto si conclude tramite prenotazione online o registrazione diretta presso l’organizzatore. La partecipazione è confermata dopo il pagamento completo.

3. Pagamento

Il pagamento avviene normalmente online oppure in contanti al punto di ritrovo prima dell’inizio della tour.

4. Partecipazione e biciclette

La partecipazione è possibile con una propria e-bike oppure con una e-bike a noleggio dell’organizzatore. In caso di noleggio si applicano anche le condizioni di noleggio di RadyBike.

Sono ammesse solo e-bike.

Le biciclette devono essere tecnicamente sicure e dotate di pneumatici adatti a diversi tipi di terreno (asfalto, ghiaia, sentieri).

L’organizzatore può controllare le biciclette prima della partenza ed escludere quelle non idonee.

5. Requisiti di partecipazione

La partecipazione avviene sotto la propria responsabilità. I partecipanti devono saper guidare una bicicletta ed essere in buone condizioni fisiche.

I minorenni possono partecipare solo con un genitore o tutore legale.

L’uso del casco è consigliato. I partecipanti devono rispettare il codice della strada.

6. Modifiche alla tour

Percorsi e orari sono indicativi. L’organizzatore può modificare il percorso o il programma per motivi di sicurezza, meteo o organizzativi.

7. Numero minimo di partecipanti

La tour richiede un minimo di 6 partecipanti. Se il numero non viene raggiunto, la tour può essere annullata o spostata. In tal caso il pagamento sarà rimborsato completamente.

8. Istruzioni della guida

I partecipanti devono seguire le istruzioni della guida. Chi non rispetta le regole di sicurezza o mette in pericolo altri partecipanti può essere escluso senza rimborso.

9. Ritardo

I partecipanti devono arrivare puntuali. In caso di ritardo la tour non attende e non è previsto rimborso.

10. Cancellazione

Le cancellazioni devono essere concordate con l’organizzatore. In caso di mancata presentazione non è previsto rimborso.

11. Annullamento da parte dell’organizzatore

La tour può essere annullata per meteo, malattia, sicurezza o numero insufficiente di partecipanti. In questo caso verrà rimborsato il 100% del pagamento.

12. Responsabilità

La partecipazione avviene a proprio rischio. L’organizzatore non è responsabile per incidenti o danni salvo dolo o grave negligenza.

13. Foto e video

Durante la tour possono essere realizzati foto o video utilizzabili per scopi promozionali.

14. Disposizioni finali

Se una clausola è invalida, le altre rimangono valide. Si applica il diritto italiano.
